Torrevieja Town Council has published notice of proceedings to declare 66 niches in the municipal cemetery structurally unsound, opening a period of ten working days for holders of burial rights to appear and make representations.

The announcement appears in the Alicante provincial gazette dated 28 October 2026 and concerns two groups in the old cemetery: 33 burial units in the northern section and another 33 in the southern section.

Who can take part

The notice addresses people who hold burial rights over the affected area, as well as anyone who can legitimately demonstrate succession to those rights, meaning that successors are also included in the procedure.

The council says it has taken steps to identify and locate the rights holders, but some people remain unidentified, some addresses are unknown and some attempts to deliver notification have been unsuccessful.

It is therefore using this notification procedure under articles 44 and 46 of Law 39/2015, which governs the common administrative procedure of Spain’s public authorities.

Inspecting the file at the town hall

The administrative file, numbered 61981/2026, is available to those affected at Torrevieja Town Hall, at number 1, Plaza de la Constitución.

During the consultation period they may examine the documents, read the full decree opening the proceedings and the municipal technical report, and provide any documents and supporting explanations they consider appropriate.

The ten working days are counted from the day after publication of the announcement in the provincial gazette; the notice does not give a specific final calendar date.

A notification within ongoing proceedings

The text refers to a mayoral decree dated 16 February 2012 which initiated proceedings, allowing the parties to be heard, to declare both groups of niches structurally unsound.

The procedure falls under article 53 of the regulations approved by Valencian government Decree 39/2005; the announcement is dated 19 October 2026 and signed by María Sandra Sánchez Andreu.

Although the gazette heading mentions clearing block 3 and counting empty niches, the body of the announcement concerns the opportunity to be heard and does not establish a timetable for physical work.
