The eviction of Pedro, a 95-year-old Benidorm resident, has been provisionally suspended while the court considers his vulnerability, according to information published on Wednesday about the proceedings.
The eviction was scheduled for 19 November and, according to his daughter Analía, no replacement date has so far been set for it to take place.
The decision gives the family some breathing space, but it does not mean the eviction case has been closed or guarantee that Pedro can remain in his home permanently.
An appeal and a decision still to come
According to his legal team, the court has upheld the lawyer’s appeal against the new eviction date and made the suspension conditional on the outcome of the separate vulnerability proceedings.
The lawyer distinguishes between the main case and that related issue, which has its own procedural steps and requires a specific ruling.
The report on the case states that both parties have been given ten days to submit arguments about the resident’s vulnerability.
Halting the eviction scheduled for November therefore does not amount to a final resolution: the assessment of his personal circumstances remains central to the next judicial step.
A social services report and a possible care home place
The social services report has already reached the court and, according to the lawyer, recognises Pedro’s vulnerability.
The same lawyer says the authorities maintain that they have a care home place available for him, a possibility that forms part of the matters still to be assessed.
The court will have to decide whether that proposal is a sufficient alternative or whether his vulnerability requires him to remain in his home.
Twenty-five years in the same home
Pedro has lived for 25 years in the Benidorm flat, which he renovated with his own hands, and both he and his daughter want him to be able to stay there.
The family had removed some household appliances because of the risk of an earlier eviction and had already faced the uncertainty surrounding a 5 October date, which was subsequently postponed.
Analía welcomes the time afforded by the suspension, while stressing that the family will not let its guard down while the decision on her father’s vulnerability remains outstanding.
